PLEASE NOTE that, due to the corona virus related university changes,

instead providing alternative assessments that fulfil the learning
outcomes. These take the form of courseworks and apply the normal

Instructions: Answer 3 questions of the 6 listed below.
Word Limit: 3000 words excluding footnotes, bibliography and other items
listed in rule 6.75 of the Academic Regulations:

Written assignments must not exceed the specified maximum number of words.
When a written assignment is marked, the excessive use of words beyond the
word limit is reflected in the academic judgement of the piece of work which
results in a lower mark being awarded for the piece of work (regulation 6.74).
Submission Date: This assignment must be submitted via Turnitin
Grade Mark on VLE by no later than 14:00 on 17 May 2021
Students can submit assignments late (ie: after the published or extended
deadline), up to five working days after the published (or extended) deadline.
The element of assessment to which the assignment contributes is capped at
40% (regulation 6.53).
Mitigation – Academic Regulations (Twelfth Edition August 2019) 6.112 –
6.118 Claims for mitigation are submitted by the student, or in exceptional
circumstances (e.g. when a student has been hospitalised) by a Director
of Studies or Student Adviser on behalf of the student, no later than five
working days after the published (or extended) submission deadline for
the assessment task or the date on which an examination was held.

Explain what he meant by that certainty, the forms it can take and the
relevant cases that interpret it.
2) Barclay’s Bank v Quistclose Investments [1970] AC 567 is the leading case

Explain what a resulting trust is, provide your own example and describe
the case.

explain in detail the ‘self-dealing rule’ with reference to the relevant cases.

dishonest assistance.

Explain which those elements are, explain the issues behind this case and
refer to other relevant applicable cases.
